By accessing or using CleverDent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CleverDent is a cloud-based dental clinic management platform that provides appointment scheduling, patient records management, AI-powered smile design, social media management, WhatsApp communication, and lead management tools.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must be a licensed dental professional or authorized clinic staff to use the Service. You agree to provide accurate and complete registration information.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious content or attempt to disrupt the Service
• Share patient data with unauthorized parties
• Resell or redistribute the Service without authorization

5. Patient Data

You are the data controller for all patient data stored in CleverDent. You are responsible for obtaining proper consent from patients and complying with applicable healthcare data regulations (GDPR, KVKK, HIPAA as applicable). We act as a data processor on your behalf.

6. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook/Instagram), WhatsApp, Google, and AI services. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party service availability or changes.

7. Intellectual Property

The Service, including its design, code, and AI models, is owned by WebWest Werbeagentur. Your data remains your property. AI-generated smile designs are provided as visualization tools and do not constitute medical advice.

8. Limitation of Liability

The Service is provided "as is". We are not liable for any indirect, incidental, or consequential damages. AI features (smile design, X-ray analysis) are decision-support tools and should not replace professional medical judgment.

9. Termination

We may terminate or suspend your account for violations of these terms. You may cancel your account at any time. Upon termination, your data will be retained for 30 days and then permanently deleted.

10. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of Austria / European Union.
